The first resolution just "authorizes" the bonds. The second resolution is for the actual sale of the bonds. That's how I interpret it.

I don't know how much land is being acquired. I wonder if the average person could request to see the plans and possibly the agreement between the Village of Caledonia and the UP. Why don't they just make documents available on the website?

the hang up. A meeting will be scheduled for this issue. Discussion followed. Attorney
Ekes explained that the board has given power to a team to make decisions on easements
and they were given the power to negotiate. The right-of- way issue needs to be finalized
with the post office before the project proceeds. Attorney Ekes feels we will get an
agreement with the post office and feels we need to expedite it.

There was a brush cutter working on the north end of the Ives Siding today.
Could this be prep work for the project or was it just time to trim the bushes and trees?

Uncle Pete's Gi-normous weed wacker! More likely a request the rock train crew put in months ago. Wish the weed sprayer would tackle Stratford Plaza - should get done before the tie replacement crew marches down the mains.

10C - Four Mile Road Crossing Agreement with the Union Pacific Railroad

Attorney Ekes explained the revision to the agreement with the Union Pacific Railroad.
The one issue she pointed out was the ownership language the railroad does not like and
felt that the maintenance of the railroad is a more important issue. Trustee Griswold felt
the maintenance language was unclear. Ekes stated the Railroad will not agree to it. The
UPR is responsible for maintaining the railroad for its lifetime and if a problem arises that
deems to be a maintenance issue, then the UPR should be responsible. Trustee Griswold
asked if it could be split 50/50. Ekes felt it wouldn’t be in the best interest of the village.

Trustee Weatherston moved, seconded by Trustee Bradley to approve the Four Mile Road
Crossing Agreement with the Union Pacific Railroad. Motion carried unanimously.

10D - Agreement to finalize the right-of-way and other remaining issues with the US
Postal Service Four Mile Road Grade Separation Project

Attorney Ekes explained the agreement and the contract negotiated with the post office.

Trustee Wanggaard moved, seconded by Trustee Bradley to approve the USPS Appraisal
subject to any additional revisions made by Village Attorney and/or Village Engineer as
long as it is consistent with the approval. Motion carried unanimously.

6. Project schedule for 4 Mile Road UPRR Bridge Underpass
Trustee Griswold is looking for a critic path schedule for this project. He would like a
one sheet schedule. Hayek stated that the utilities have until September 1 to complete
their work. We would start the project on September 6. Trustee Griswold would like a
schedule completed for the next meeting. Hayek feels the work would last one year.

Trustee Dobbs asked if there is an alternate traffic plan for when 4 Mile Road is closed.
Discussion followed. Hayek said 4 Mile Road carries approximately 10,000 cars per day.
Pfeffer doesn’t feel the problem will be that bad once people find an alternative route.

Hayek reported that there will be $464,000 for construction management costs. He is
currently working on a railroad agreement. We should go out for bids in about one
month or six weeks.

Federal law says the railroad will pay 5% of cost of an underpass. Discussion followed on
what the cost consists of. Our list of what is included in the cost is different than what
the railroad’s list is. The village attorney is working with them. 8.6 million is the total
cost of the project. The railroad does not want to pay 5% of this total cost.

Trustee Griswold would like to know what the railroad paid for with the 6 Mile Road
underpass. Hayek said in two weeks the village board should have the number agreed
upon with the railroad. Trustee Griswold would like the board to be informed with the
progress.

railroad base form. She also gave a brief update of the status of the project. Trustee

Trustee Wishau moved, seconded by Trustee Burton to lay over Resolution 2011-05.
Motion carried.

I noticed new wooden power/telephone poles along 4 Mile Road around the rail crossing. Looks like the lines are going to be moved to get ready for construction!

yet. She updated the board with the projects schedule including an October 1st
anticipated start date. Trustee Burton asked for some clarity regarding the railroads lack
of commitment to ownership. Trustee Griswold talked about the projects schedule and
felt the Railroad Crossing Agreement should be added to it. He also felt the board should
be involved in the review of preliminary plans, conceptual plans and drawings. Trustee
Wanggaard expressed his concern regarding the excessive amount of time it has taken to
get the project started. Ekes stated that as soon as she receives the Agreement and
reviews it, she will request a special board meeting.

Trustee Burton moved, seconded by Trustee Weatherston to lay over the adoption of
Resolution 2011-05 until the revised Agreement has been received and reviewed.
Motion carried.


From the 07/13/2011 Caledonia Public Works Meeting Minutes:

Quote:
8. Project schedule for 4 Mile Road UPRR Bridge Underpass
Hayek said on July 28 and August 4 they will advertise for bids. At the August 30th
Finance Committee bids will be opened. This will then go to the Sept. 6th village board
meeting. The project is scheduled to start construction on 9/26/11 ending 9/23/12.
Hayek would have liked to have the final railroad agreement but will include the numbers
that he currently has. Sewer and water work will be done first along with the post office
parking lot and the road will not have to be closed for that work. Discussion followed on
some issues that have come up so far.

Trustee Griswold would like a written schedule from Hayek. Hayek said he will delay
the bid opening if he does not have a final railroad crossing agreement.


9. Discussion of 4 Mile Road UPRR Railroad Crossing Agreement
Hayek explained the hold up. We have asked for 5% of the new 2011 estimates because
the costs have gone up. He hopes to have the new numbers by bid opening. This will be
on the village board agenda even if it has to be with the old numbers. The committee
feels we need to move forward. Hayek will continue with the current schedule and do
new numbers as an addendum, if need be.
